As a healthcare provider, Best Behavior Solutions is legally required to maintain the privacy of your child’s Protected Health Information (PHI) and to provide you with this notice of our legal duties and privacy practices.

Uses and Disclosures of Health Information

We use and disclose PHI for the core purposes of Treatment, Payment, and Healthcare Operations (TPO):

  • For Treatment: We may disclose PHI to our Board Certified Behavior Analysts (BCBAs), Registered Behavior Technicians (RBTs), and other healthcare professionals involved in designing, managing, or delivering your child’s ABA therapy.
  • For Payment: We may use and disclose PHI so that the services your child receives can be billed to and payment collected from Georgia Medicaid, PeachCare for Kids®, or other authorized payors.
  • For Healthcare Operations: We may use PHI to run our practice smoothly, perform clinical quality audits, train staff, and ensure we are maintaining the highest standards of clinical integrity.

Other Permitted or Required Disclosures

We may disclose PHI without your authorization only in limited situations mandated by law, including:

  • Reporting suspected child abuse or neglect.
  • Responding to a court order, subpoena, or legal warrant.
  • Preventing a serious and imminent threat to health or safety.

Part 3: Technology & Artificial Intelligence (AI) Disclosure

To provide premium, secure behavioral health services, Best Behavior Solutions utilizes vetted clinical platforms and secure operational tools.

  • Clinical Data Collection: We utilize HiRasmus, a secure, fully HIPAA-compliant platform, for real-time clinical data collection. Our therapy team uses this tool during sessions to track your child’s daily progress, graph behavioral milestones, and manage individualized learning programs securely.
  • Practice Management & Billing: We utilize AlohaABA, a secure, fully HIPAA-compliant software platform, to store formal clinical documentation, manage scheduling, and process insurance billing.
  • Administrative AI Efficiency & “Human-in-the-Loop” Guarantee: To optimize administrative workflows, draft documentation, and analyze systemic operational trends, we utilize Google Gemini Workspace under an enterprise-grade Business Associate Agreement (BAA) that structurally protects PHI from external exposure.
    • No Automated Decisions: We maintain a strict “Human-in-the-Loop” protocol. No artificial intelligence tool or automated system is ever used to make clinical judgements, determine medical necessity, or independently alter a client’s treatment plan.
    • Clinical Oversight: Every single clinical report, goal modification, and treatment note is personally reviewed, edited, verified, and signed off by Dr. Best to guarantee total clinical accuracy and ethical care.

Part 4: Your Individual Rights

Under federal law, parents and legal guardians have the following rights regarding their child’s PHI:

  • Right to Inspect and Copy: You have the right to inspect and receive a paper or electronic copy of your child’s clinical and billing records.
  • Right to Request Restrictions: You may request that we restrict how we use or disclose PHI for treatment, payment, or operations. While we will carefully consider all requests, we are not legally required to agree to every restriction.
  • Right to Amend: If you feel the health information we have is incorrect or incomplete, you may request an amendment in writing.
  • Right to an Accounting of Disclosures: You have the right to request a list of certain disclosures we have made of your child’s PHI outside of standard treatment, payment, and operations.
